1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your access to and use of the website at https://i-amq.com (the "Site"), operated by Aleksandr Myshkin ("Controller," "We," "Us," or "Our"), and your subscription to our digital newsletters ("Services"). By accessing the Site or subscribing to the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Eligibility and Age Restriction

The Site and Services are intended solely for users who are eighteen (18) years of age or older. By using the Site or subscribing to the Services, you represent and warrant that you are 18 years of age or older.

3. Services and Subscription Terms

We offer two email newsletters:
"The Old Tools Letter": A paid, monthly subscription service.
" The Garage Letter": A free, newsletter.

A. Paid Subscription ("The Old Tools Letter")

Billing: The fee is $30 per month, billed monthly in advance via Stripe. Subscription automatically renews unless cancelled by the User.
Cancellation: You may cancel your subscription at any time by clicking the "Unsubscribe" link provided in every email

Automatic Renewal Disclosure: Your paid subscription will automatically renew each month at the stated rate unless you cancel before the renewal date. By completing your purchase, you authorize recurring charges to your selected payment method until you cancel.

No Refunds Policy: ALL SALES ARE FINAL. Fees are non-refundable. We do not provide refunds or credits for any partial subscription period, or for content that you have already received. Refunds will only be considered in cases of documented billing errors (e.g., accidental double-charges). To report a billing error, you must contact us immediately via the Site's contact form or by email at: contact@i-amq.com.

B. Free Subscription ("The Garage Letter")

This newsletter is provided free of charge. You may voluntarily offer financial support (donations) via the "Support" page link to Stripe, but this is not required for access to the content.

Cancellation: You may unsubscribe at any time by clicking the "Unsubscribe" link provided in every email.

4. Intellectual Property Rights

A. Ownership: The Site, its newsletters, the content archive ("Tool Chest"), and all digital content, including text, images, and links to YouTube videos, are the sole property of Aleksandr Myshkin.

B. Trademarks: I-amQ™ and other proprietary terms used on the Site and in the Services are trademarks of Aleksandr Myshkin. The I-amQ methodology is protected under applicable intellectual property laws. C. Limited License and Restrictions: You are granted a limited, non-exclusive, non-transferable license to access and use the content for your personal, non-commercial use only. You may not share, distribute, reproduce, or modify the content, in whole or in part, without our express written permission. We reserve all rights not expressly granted herein.

5. Data Collection and Privacy

A. Information Collected: We limit the collection of Personal Data to the email address for subscriptions (via MailerLite) and the name and email address for contact form submissions. We do not sell or rent your personal information to any third parties

B. Third-Party Processors: We utilize Stripe for payment processing and MailerLite for email services. These third parties collect data necessary for transaction processing and email delivery. Your use of the Services signifies your acceptance of their respective privacy policies. C. No Interactive Content: The Site does not offer user accounts, forums, or comment sections and does not host User Generated Content.

6. Disclaimer of Professional Advice and Assumption of Risk

A. Content is Informational Only (AS IS): All content provided on the Site and in the newsletters is for INFORMATIONAL PURPOSES ONLY and is provided AS IS.

A. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

B. Binding Arbitration: Any dispute arising out of or relating to this Agreement shall be resolved exclusively through binding arbitration conducted in Delaware, in English, under the rules of the American Arbitration Association (AAA). Each party waives the right to participate in a class action or class-wide arbitration. Judgment on the arbitration award may be entered in any court having jurisdiction thereof. The arbitration shall be conducted on an individual basis; class actions and class arbitrations are not permitted.

9. EU/EEA Resident Disclaimer

TERRITORIAL RESTRICTION AND GDPR APPLICABILITY

This Service is intended solely for users in the United States. We do not offer, target, or make this Service available to individuals residing in the European Union (EU) or European Economic Area (EEA). All personal data collected through this Service is processed and stored exclusively in the United States of America. Due to this territorial limitation and the absence of intentional targeting of EU/EEA residents, the General Data Protection Regulation (GDPR) and the EU's ePrivacy Directive are generally deemed not applicable to the data processing activities of this Service. If you are a resident of the European Union (EU) or the European Economic Area (EEA), please discontinue use of this Service.
